JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 19-05-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This is an application seeking anticipatory bail in a case registered for the offences punishable under Sections 147,148,323,353,120B of the Indian Penal Code. The Informant is the Panchayat Secretary. Allegedly, while distributing the ration cards on the alleged date of occurrence, the petitioner and other persons started an altercation and attempted to assault the informant. The accused persons are said to have abused the informant and snatched a sum of Rs. 600/- and two hundred eleven cards.

Patna High Court Cr.Misc. No.3053 of 2015 (3) dt.19-05-2015 submitted that a malicious case has been instituted by the Panchayat Secretary and the petitioner and others were rasing voice against the irregularities committed by the Panchayat Secretary.

In view of the submissions as above, let petitioner above named in the event of his arrest/surrender within four weeks from today in the Court below be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East champaran in connection with Motihari Muffasail P.S. Case No. 165 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
