JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 19-05-2015 Heard learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners apprehend their arrest in connection with Raghunathpur P.S. Case No. 123 of 2014 registered under Sections 147, 148, 323, 324, 307, 304(b) and 201/34 of the Indian Penal Code.
Learned counsel for the petitioners submits that it would appear from the F.I.R. that occurrence took place due to land dispute, while the petitioners are named in the F.I.R. along with four others but no specific overt act has been alleged against the petitioners and the injuries as found on the person of the informant is simple in nature. Patna High Court Cr.Misc. No.11040 of 2015 (3) dt.19-05-2015 further submits that other co-accused, Rajendra Pratap Singh @ Rajendra Singh, Ranjeet Singh, Rakesh Singh and Pankaj Singh have already been granted privilege of anticipatory bail by a Bench of this Court vide order dated 25.03.2015 passed in Criminal Misc. No. 12393 of 2015.
Considering the aforesaid submissions, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan, District Siwan, in connection with Raghunathpur P.S. Case No. 123 of 2014, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
