The petitioner seeks bail in a case instituted for the offences under Section 37(i)(ii) of the Bihar Prohibition and Excise Act, 2016.

Prosecution case, in short, is that the petitioner was creating nuisance in drunken state.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 4.2.2020 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. There is no recovery of liquor from the possession of the petitioner. The allegation made in the F.I.R. is denied by the petitioner.

On behalf of the State, it is submitted that the

Patna High Court CR. MISC. No.14525 of 2020(2) dt.02-03-2020 2/2 petitioner is named in the F.I.R/complaint case. Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-3th -cum- Special Judge, Excise, Kaimur at Bhabua in connection with Excise Case No. 118 of 2020 arising out of Bhabua P.S. Case No. 77 of 2020.
