The petitioner is seeking regular bail in Mushahari P.S. Case No. 49/2018 registered for offences under Sections 393, 414, 506/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that from perusal of the Fardbeyan giving rise to the present case it will appear that the allegation of snatching the bag containing money is against coaccused Neeraj Kumar, so far as the present petitioner is concerned it is alleged that he was driving the motorcycle in question. On search, from the possession of this petitioner one ATM card of United Bank of India was recovered which belonged to his family member. It is submitted that so far as the amount of Rs. 5000/- which was allegedly snatched from the informant is

Patna High Court Cr.Misc. No.32242 of 2018 (2) dt.11-06-2018 2/2 concerned, the same has not been shown recovered / seized from the possession of this petitioner.

Learned A.P.P. for the State is present.

Considering the fact that the petitioner has got no criminal antecedent and neither the F.I.R. nor the seizure list shows recovery of snatched amount from the possession of the petitioner, let the petitioner, named above, be released on bail on his furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. VI, Muzaffarpur in connection with Mushahari P.S. Case No. 49/2018, subject to the conditions as laid down under Section 437(3) Cr.P.C. One of the sureties would be a family member of the petitioner having no criminal antecedent and in case the petitioner is found involved again in any criminal offence the bail bond of the petitioner shall be liable to be cancelled.
