JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 21-07-2022 Learned counsel for the petitioners is permitted to remove defect (s), as pointed out by the office, if any, within a period of four weeks on resumption of physical mode. Heard learned counsel for the petitioners and learned APP for the State.

The petitioners have preferred this application for grant of regular bail in a case registered under sections 147, 148, 149, 323, 341and 307 of the Indian Penal Code. As per the prosecution case, the petitioners along with other co-accused persons assaulted seven persons out of whom four persons sustained severe injuries on their heads and others also sustained severe injuries on their bodies.

No.17119 of 2022(2) dt.21-07-2022 2/2 Learned counsel for the petitioners has submitted that the petitioners are innocent and they have falsely been implicated in this case. Learned counsel for the petitioners has further submitted that the injuries are stated to be simple in nature, so Section 307 of I.P.C. is not attracted in this case. The petitioners have clean antecedent as stated at para 3 of the bail petition. The petitioners are in custody since 04.02.2022. Learned A.P.P. for the State has opposed the bail petition of the petitioners.

Considering the aforesaid facts and circumstances, the petitioners above-named, are directed to be enlarged on bail on his furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Madanpur P.S. Case No. 47 of 2022. The application stands allowed.
