Petitioner apprehends arrest in a case registered for the offences punishable under Sections 406/420 of the Indian Penal Code.

Prosecution's case, in brief, is that the petitioner by executing agreement paper took poultry feeds on credit worth of Rs.4,11,353/- but even after lapse of three years he did not pay the said amount.

Learned counsel appearing for the petitioner submits that the petitioner has falsely been implicated in this case. He submits that for the transaction of 2016, FIR has been lodged in 2019, without explanation of delay. Petitioner has got no criminal antecedent.

No.15895 of 2020(2) dt.10-07-2020 2/2 Considering the facts of the case, let the petitioner, above named, in the event of arrest/surrender, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate 1st class, Muzaffarpur in Ps. Case No.-33 Year-2019 Thana- Bela Industrial District- Muzaffarpur on the following conditions:-

(1) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present as directed by the Court and on his absence on two consecutive dates without sufficient reason, his bail bond shall be cancelled by the Court below.

(2) If the petitioner tampers with the evidence or the witnesses, in that case the prosecution will be at liberty to move for cancellation of bail.
