====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 20-09-2017 Heard the learned counsel for the petitioner. The petitioner seeks regular bail in connection with Barauni P.S. Case No. 92 of 2017 for the offences punishable under Sections 401/34 of the Indian Penal Code. The case of the prosecution is that the police received secret information with regard to certain criminal planning to commit crime along with his associates, whereafter the police personnel are said to have arrived at the western side of plateform No.9 at 16.45 hours on 24.5.2017 and on seeing the police personnel, the culprits started fleeing away. On chase by the police, three culprits namely, Upendra Sah, Umesh Sah and the petitioner herein were apprehended.

The learned counsel for the petitioner submits that as

Patna High Court Cr.Misc. No.45758 of 2017 (2) dt.20-09-2017 2/2 far as the petitioner is concerned, a sum of Rs. 160/- and one mobile phone was recovered. However, no stolen articles are said to have been recovered. It is further submitted that co-accused Umesh Shah has already been granted bail by the learned trial court. It is stated that the petitioner is languishing in jail since 24.5.2017.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate Rail Court, Barauni, Begusarai in connection with Barauni Rail P.S. Case No. 92 of 2017 (G.R. No. 109 of 2017).
