JUSTICE MOHIT KUMAR SHAH ORAL ORDER 31-05-2018 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks regular bail in connection with Chauri PS case no. 57 of 2017 instituted for the offences punishable under Section 392 of Indian Penal Code. The allegation is regarding the accused persons having abducted the informant of the present case and thereafter, are stated to have stolen the tractor, which is traceless till date. The learned counsel for the petitioner submits that the petitioner is a non-FIR named accused person and his name has transpired during the course of the investigation upon the confessional statement made by co-accused namely Santosh

Patna High Court Cr.Misc. No.31619 of 2018 (2) dt.31-05-2018 2/2 Kumar Samrat @ Sunny. It is further submitted that the petitioner is languishing in custody since 05.12.2017.

Having regard to the facts and circumstances of the case, the abovenamed petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M. 12th, Bhojpur at Ara in connection with Chauri PS case no. 57 of 2017.
