Petitioner apprehends arrest in a case registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code as well as undr section 27 of the Arm Act.

Accusation against this petitioner is that because of some earlier dispute, petitioner and one Fulo Yadav are alleged to have assaulted Mantosh Kr. Sharma, uncle of informant with fists and legs. They also tried to take away his motorcycle and on protest they fired at him. Bullet fired by Fulo Yadav hit the thigh of the informant.

Learned counsel appearing for the petitioner submits that the petitioner has falsely been implicated in this case. He is not the author of the injury caused to the informant. Petitioner has got no criminal antecedent.

No.15084 of 2020(2) dt.07-07-2020 2/2 Considering the facts of the case, let the petitioner, above named, in the event of surrender before the Court below be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Madhepura in Madhepura Gailadh Police Station Case No. 1037 of 2019, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
