19-09-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

Petitioner, in the present case, is seeking regular bail in connection with Gopalganj Town P.S. Case No. 297/2017 registered for the offence punishable under Sections 414/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has been arrested by the police and the allegation against the petitioner is that he could not explain the ownership of the black colour Honda Motorcycle bearing Registration No. BR28B-077.

Learned counsel submits that the petitioner is innocent and has been falsely implicated in the present case.

Patna High Court Cr.Misc. No.44434 of 2017 (2) dt.19-09-2017 Petitioner has no criminal history and he is in custody since 13.07.2017.

Learned Additional Public Prosecutor for the State opposes the prayer for bail of the petitioner. In the facts and circumstances of the case considering that the petitioner has no criminal history, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj, in connection with Gopalganj Town P.S. Case No. 297/2017, subject to condition as laid down under Section 437(3) of the Code of Criminal Procedure and further condition that one of the bailors must be a family member of the petitioner having no criminal antecedent.
