1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The learned counsel for the petitioner submits that petitioner and the informant are relative and on account of earlier existing dispute, the petitioner has been falsely implicated in the instant case by the informant with an allegation that he fired causing firearm injury but then the F.I.R. has been instituted after a delay of 13 days. It is next submitted that the injured was not taken to a government hospital but to a private hospital, which further casts an aspersion on the case of the prosecution. It is next submitted that on intervention of well wishers, the parties have compromised.

3. The learned APP submits that no doubt there is

No.18028 of 2024(2) dt.05-04-2024 2/2 delay in instituting the F.I.R. and the injury report is not of a government hospital but then allegation is of firing causing injury but then the learned APP further submits that if the parties have compromised in that event the petitioner should go and surrender and seek regular bail.

4. At this stage, the learned counsel for the petitioner seeks permission to withdraw the anticipatory bail application of the petitioner.

5. Permission is accorded.

6. The anticipatory bail application of the petitioner is dismissed as withdrawn.
