The petitioner seeks bail in a case registered for the offence punishable under Sections 323, 448, 504, 376 and 511 of the Indian Penal Code.
Petitioner is said to have tried to outrage the modesty of the wife of the informant intruding into his house and on protest made by him assaulted and slated him. It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. Petitioner has no concern with the aforesaid occurrence. He has been falsely implicated in the case by the informant due to land dispute. As a matter of fact, petitioner happens to be young boy aged about 22
Patna High Court Cr.Misc. No.31425 of 2018 (2) dt.22-05-2018 2/2 years and the victim is aged about 50 years, so no question of such occurrence arises. Victim has also not turned up before the police for recording her statement by the police. The petitioner has been languishing in custody since 28.03.2018.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 4th, Saran at Chapra in connection with Dariyapur P.S. Case No. 38 of 2018.
