====================================================== CORAM: HONOURABLE JUSTICE SMT. SONI SHRIVASTAVA ORAL ORDER 15-05-2025 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 498(A), 494, 341, 323, 379, 34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.
3. The petitioner, who is husband of the informant, in association of his family members are said to have assaulted and tortured the informant due to non-fulfillment of demand of dowry.
4. The matter had earlier been referred to the Patna High Court Mediation Centre for resolution of disputes between the
Patna High Court CR. MISC. No.20389 of 2024(5) dt.15-05-2025 2/3 parties and it appears from the mediation report kept at Flag 'M' of the bail application that the parties have reached an amicable settlement vide agreement dated 02.05.2025 passed in Mediation Proceeding No. 187 of 2025 whereby they have agreed to stay peacefully with each other as husband and wife along with their son. It has also been agreed that the petitioner would keep his wife with due dignity and honour and would not subject her to any misbehaviour. It has further been agreed between the parties that after having a peaceful conjugal relationship with each other for three months, the parties would cooperate with each other in bringing the litigations to an end.
5. In such view of the matter, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Mahila P.S. Case No. 01 of 2023, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
6. However, it goes without saying that both the parties
