This is an application for bail in connection with Madhubani Town P.S. Case No. 330 of 2016, registered for the offences punishable under Sections 467, 468, 471 and 420 of the Indian Penal Code.

Allegation against the petitioner is that he used the forged pass port and it further appears that an enquiry was made and it was found that he has mentioned wrong date of birth and the said pass port has also been renewed by him.

Submission of learned counsel for the petitioner is that pass port has been prepared on the basis of Aadhar card and he has applied for correction on the basis of his Matriculation Certificate and except that there is no other allegation against him and he is in custody for three months and charge sheet has been submitted in this case.

Heard learned APP and learned counsel for the informant, who have opposed the prayer for bail vehemently on

No.47556 of 2017 (3) dt.08-11-2017 2/2 the ground that petitioner is also carrying one more pass port in his name but police has not investigated the same on the plea that copy of the same has not been provided to police. Having heard both sides and in view of facts and circumstances, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Madhubani, in connection with Madhubani Town P.S.Case No. 330 of 2016, subject to the conditions as follows :

(1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned, (2) Petitioner will co-operate in trial and appear on each and every date in court and on failure to appear on two consecutive dates without any genuine ground or without permission of court, his bail bond shall be cancelled.
