JUSTICE RAKESH KUMAR ORAL ORDER 25-06-2018 Heard Sri Rajesh Kumar Singh, learned counsel, assisted by Sri Rana Pratap Singh, learned counsel for the petitioners. None appeared on behalf of the State. Two petitioners, who are in custody since 09.04.2018 in Bhabua P.S. Case No.255 of 2018 registered for the offence under Section 379/411/34 of the Indian Penal Code, have prayed for grant of bail.
At the very outset, learned counsel for the petitioners has drawn my attention to the statement made in paragraph-3 to the petition to show that the petitioners are having clean antecedent . It has further been argued that on false accusation of recovery of motorcycle, allegedly stolen from a Petrol Pump,
Patna High Court Cr.Misc. No.33939 of 2018(2) dt.25-06-2018 2/2 petitioners have been made accused.
Considering the nature of accusation, clean antecedent of the petitioners as well as period of custody, let both petitioners, namely, (i) Anand Kumar and (ii) Sandeep Kumar be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate , Kaimur at Bhabua in connection with Bhabua P.S. Case No..255 of 2018.
