The petitioner seeks bail in Naubatpur P.S. Case No. 422 of 2019, registered for the offence punishable under Section 506, 386, 387, 120B and 34 of the Indian Penal Code. Earlier the bail application of petitioner was rejected vide order dated 12.07.2021. Petitioner renews his prayer for bail on two grounds. Firstly, similarly situated co-accused namely, Vikash Kumar whose mobile has been used in demanding extortion has been granted bail by a coordinate Bench of this Court vide order dated 07.12.2021 passed in Cr. Misc. No. 28125 of 2021. Secondly, during trial three witnesses have been declared hostile and they have not supported the
Patna High Court CR. MISC. No.16599 of 2022(2) dt.06-04-2022 2/2 prosecution case. Petitioner is in custody since 28.08.2019. Counsel for the State however, vehemently opposed the prayer for bail and submitted that petitioner has got criminal antecedents and he is accused in 15 more cases. Considering the nature of accusation, criminal antecedent and the fact that no fresh ground or any changed circumstances have been brought on record for reconsideration of his prayer for bail, I am not inclined to enlarge the petitioner above-named on bail.
