The petitioner seeks regular bail in connection with Turkauliya P.S. Case No. 171 of 2018 for the offences punishable under Sections 272, 273, 290 of Indian Penal Code and Sections 30(a), 38, 41, 37 (b) of the Bihar Prohibition and Excise Act. The allegation is regarding recovery of 18 liters of illicit foreign liquor from agricultural land situated at the back of the house of the petitioner.
The learned counsel for the petitioner submits that neither any recovery has been made from the conscious possession of the petitioner nor the said field belongs to the petitioner. It is further submitted that the petitioner is having a clean antecedent and is languishing in custody since 27.03.2018.
Patna High Court Cr.Misc. No.31809 of 2018 (2) dt.31-05-2018 2/2 Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, East Champaran, Motihari in connection with Turkauliya P.S. Case No.171 of 2018.
