The petitioner has preferred this application for grant of regular bail in a case registered under section 30 of the Bihar Prohibition and Excise Act, 2016 As per the prosecution case, about 7.8 litres of liquor was recovered from the possession of the petitioner. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his possession. He has been falsely implicated in the case because of his antecedents. He is in custody since 21.1.2021. The application for bail is opposed by learned APP for the State who submits that the petitioner is having as many as eight cases against him from before of which five cases are

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for 1 year, the Court directs the petitioner to be enlarged on bail in connection with Jamhor P.S. Case no. 8 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge II-cum-Special Judge, Excise, Aurangabad.
