No. 39625 of 2015 learned counsel for the petitioner seeks permission to withdraw this application with liberty to file petition before the learned court below itself as opposite party no. 2 has not complied with the order for depositing Rs. 8,45,000/- in three equal installments. Prayer is allowed. This application is disposed of with the liberty aforesaid granted to the petitioner.
