The petitioner has preferred the instant application for grant of regular bail in a case registered under section 307 and other sections of the Indian Penal Code and sections 25(1-B)(a), 26, 27 and 35 of the Arms Act.

As per the prosecution case, the accused persons including the petitioner herein are stated to have assaulted the grand mother of the informant, the informant as also her father. It is stated that Manish Yadav and the petitioner herein assaulted the father of the informant with a sword on his head. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. The allegations in the F.I.R. are falsified from the injury report of the

No.26226 of 2021(3) dt.26-11-2021 2/2 father of the informant which is Annexure-2 to the petition from which it would transpire that only one injury has been found and that too being lacerated, does not support the allegations in the F.I.R. The petitioner is in custody since 31.10.2020 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the contents of the injury report as also the petitioner having remained in custody for one 1 year, this Court directs the petitioner to be enlarged on bail in connection with Hisua P.S. Case no.414 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada (Partha Sarthy, J) Bibhash U
