1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner has preferred this application for grant of regular bail in connection with Belaganj P.S. Case no. 25 of 2024 registered under sections 354B, 323, 341, 504 and 34 of the Indian Penal Code and sections 8 and 12 of the POCSO Act.

3. As per the prosecution case, the informant states that while his minor daughter was returning, having gone to ease herself, it is stated that the petitioner caught hold of her with an intention to commit rape, threw her on the ground but on the daughter raising halla and the informant reaching there, the petitioner escaped.

4. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.20287 of 2024(2) dt.02-04-2024 2/2 petitioner has been falsely implicated in the case for oblique reasons. No such occurrence has taken place as alleged in the F.I.R. The petitioner is in custody since 13.1.2024 and has no criminal antecedent.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner in the F.I.R, his being in custody since 13.1.2024 and not having any criminal antecedent, the petitioner is directed to be enlarged on bail in connection with Belaganj P.S. Case no. 25 of 2024, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge POCSO Court-cum-Additional District and Sessions Judge-VIth, Gaya.
