JUSTICE MOHIT KUMAR SHAH ORAL ORDER 07-04-2021 The learned counsel for the petitioner submits that on account of inadvertence, the depiction of the learned court below had been wrongly mentioned in the petition bearing Criminal Misc. No. 9260 of 2021, hence error has crept in the order dated 24.02.2021, however, he submits that the same be rectified in the interest of justice.

Having regard to the facts and circumstances of the case and considering the averments made in the present petition as also taking into account the submissions made by the learned counsel for the petitioner, I deem it fit and proper to direct that the depiction of the learned court below in the order dated 24.02.2021 passed in Criminal Misc. No. 9260 of 2021 be read as the learned court of 1st Class Judicial Magistrate, Gaya.

Patna High Court CR. MISC. No.22507 of 2021(2) dt.07-04-2021 2/2 Accordingly, the time period granted to the petitioner by this Court for the purposes of surrendering before the learned court of 1st Class Judicial Magistrate, Gaya in connection with Complaint Case No. 107 of 2018, is extended by a further period of six weeks from today.

The present petition stands disposed off with the aforesaid modification in the order dated 24.02.2021 passed in Criminal Misc. No. 9260 of 2021.
