JUSTICE MOHIT KUMAR SHAH ORAL ORDER 01-04-2019 The present writ petition has been filed for quashing the office order dated 31.08.2018 issued by the District Education Officer, Nawada by which the petitioner has been placed under suspension and a departmental proceeding has been sought to be initiated inasmuch as a Conducting Officer has been appointed for holding the inquiry.

The learned counsel for the petitioner submits that already seven months have passed, but no headway has taken place in the ongoing departmental proceeding, hence, a direction is required to be issued to conclude the departmental proceeding expeditiously. It is further complained that the subsistence allowance is also not being paid to the petitioner.

Patna High Court CWJC No.6180 of 2019(2) dt.01-04-2019 2/2 Having regard to the facts and circumstances of the case, the Disciplinary Authority is directed to serve the copy of charge-sheet along with the annexures upon the petitioner herein, if not already served and ensure completion of the disciplinary proceedings and passing of the final order within a period of four months from receipt / production of a copy of this order failing which the order of suspension dated 31.08.2018 shall stand revoked automatically.

It is further directed that in the meantime, the admitted dues of subsistence allowance, outstanding for payment, shall be paid to the petitioner forthwith. (Mohit Kumar Shah, J) ajay gupta/- U
