The petitioner seeks regular bail in connection with Saraiya P.S. Case No. 841 of 2020 instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner is in custody since 03.02.2021, is a person with clean antecedent and from bare perusal of the allegation as alleged in the F.I.R. it would manifest that total 645.99 litres foreign liquor is alleged to have been recovered from a van which does not belong to the petitioner.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

No.27334 of 2021(2) dt.22-11-2021 2/2 Considering the fact that the petitioner is in custody since 03.02.2021, charge-sheet has been submitted in the case and the petitioner is a person with clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 5,000/- (Rupees Five Thousand only) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Muzaffarpur in connection with Saraiya P.S. Case No. 841 of 2020 subject to the condition as laid down under Section 437 (3) Cr.P.C.
