JUSTICE SANJAY KUMAR ORAL ORDER 21-09-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner seeks bail in connection with Salkhua Police Station Case No. 34 of 2017 registered for offences punishable under sections 147, 148, 149, 341, 323, 307 of the Indian Penal Code and section 27 of the Arms Act. Allegation is that altogether 9 accused persons including the petitioner named in the FIR intercepted the brother of the informant and assaulted him and out of them this petitioner and Gautam Rai allegedly shot fire on the victim. The learned counsel for the petitioner submits that the allegation of firing is against two persons, but the injury report shows only one superficial charred injury, below waist on right side. The occurrence of assault took place in Saharsa district

Patna High Court Cr.Misc. No.46873 of 2017 (2) dt.21-09-2017 2/2 whereas the victim was treated at Begusarai by a private Doctor, who has reported two injuries, one lacerated and another abrasion, which were simple in nature. The petitioner is in custody since 30.06.2017 having clean antecedent.

Considering the facts and circumstances of the case, the petitioner- Naga Roy is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Saharsa in connection with Salkhua Police Station Case No. 34 of 2017.
