JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 01-04-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Sakri P.S. Case No. 79 of 2018 for the offenses under Section 395 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent. The case was registered against unknown. The petitioner is in custody since 28.10.2018 but till date no Test Identification Parade has been held which is obligatory on the part of the prosecution to identify the real miscreants.

Considering the fact that the petitioner has no criminal antecedent and the case was registered against

Patna High Court CR. MISC. No.19703 of 2019(2) dt.01-04-2019 2/2 unknown and the petitioner has not been put on TIP till Date, the court is inclined to grant him bail. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Madhubani in connection with Sakri P.S. Case No. 79 of 2018.
