Petitioner happens to be father-in-law of the informant and apprehends his arrest in connection with Mahila P.S.Case No 09 of 2015 registered under section 498A/34 of the Indian Penal Code and 3⁄4 of the Dowry Prohibition Act.

It would appear that earlier, a co-ordinate Bench of this Court directed the office to take this petition along with Cr.Misc No. 31114 of 2015 but due to typographical error in place of 31114 of 2015, it was wrongly typed as 3114 of 2015, but subsequently, the aforesaid defect was rectified vide order dated 27.01.2016 but in the meantime Cr. Misc. No 31114 of 2015 was disposed of and the husband of the informant was granted privilege of anticipatory bail by a co-ordinate Bench of this court vide order dated 02.11.2015 passed in Cr.Misc. No. 31114 of

Patna High Court Cr.Misc. No.25232 of 2015 (8) dt.09-03-2016 2/2 2015.

Learned counsel for the petitioner points out that the informant as well as her husband settled their dispute by way of one time settlement and taking note of the aforesaid facts, the husband of the informant has already been admitted to anticipatory bail and, therefore, there is no need to send the petitioner behind the bar.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Patna in Mahila Police Station Case no. 09 of 2015, subject to condition as laid down under Section 438(2) of the Cr.P.C.
