====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 13-06-2018 Heard Dr. Shashi Shekhar Kishore, learned counsel for the petitioner and Sri Satya Nand Shukla, learned Additional Public Prosecutor.

The sole petitioner, apprehending his arrest in connection with Teghra P.S. Case No. 27 of 2018, registered for offence under Section 30 / 30(A) of the Bihar Prohibition and Excise Act , 2016 and G.R. No. 271 of 2018, has prayed for grant of bail in the event of his arrest or surrender. At the very outset, learned counsel for the petitioner has drawn my attention to statement made in paragraph no. 3 of the petition to show that petitioner is having clean antecedent. It has also been argued that nothing has been recovered either from conscious possession of the petitioner or premises of the

Patna High Court Cr.Misc. No.32798 of 2018(2) dt.13-06-2018 2/2 petitioner, rather in the case recovery from outside of Western side of the house of the petitioner was shown and since recovery was affected from near the house of the petitioner , petitioner has been arrayed as accused.

Considering the fact that petitioner is having clean antecedent and nothing was recovered either from his conscious possession or his premises, in the event of his arrest or surrender within a period of six weeks from today, let the petitioner Raju Sah @ Raju Kumar Sah be enlarged on bail on furnishing bail bond of Rs. 10,000/- ( rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned A.D.J.- II- cum- Special Judge, Excise Court Begusarai / concerned court in connection with Teghra P.S. Case No. 27 of 2018 , G.R. No. 271 of 2018 subject to the conditions as contemplated under Section 438 (2) of the Code of Criminal Procedure, 1973.
