JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 04-06-2018 Heard learned counsel for the petitioner and State. The petitioner is in custody since 31.03.2018 in connection with Sheohar P.S. case no. 40 of 2018 for the offences under Section 120(B) of the Indian Penal Code and Section 30 (a)/47 of the Bihar Prohibition and Excise Act 2016. Learned counsel for the petitioner submits that nothing was recovered for the possession of the petitioner. He further submits that the petitioner has been made accused on the basis of confessional statement of co-accused Munna Singh. He further submits that similarly circumstanced co-accused, namely, Lal Bahadur Sah @ Lal Bahadur Singh has been granted bail vide order dated 19.04.2018 in Cr. Misc. No. 22709 of 2018, Rajan Sah @ Raj Prasad Gupta has been granted bail vide order dated 07.05.2018 in Cr. Misc. No. 27271 of 2018, Sonu Kumar has been

Patna High Court Cr.Misc. No.32828 of 2018 (2) dt.04-06-2018 2/2 granted bail vide order dated 16.04.2018 in Cr. Misc. No. 21091 of 2018 and Surendra Sah has been granted bail vide order dated 01.05.2018 in Cr. Misc. No. 23202 of 2018.

Considering the fact that similarly circumstanced other co-accused have been granted bail, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-Icum-Special Judge, Sheohar in connection with Sheohar P.S. case no. 40 of 2018.
