Mr.Ramesh Chandra ====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 26-06-2024 Heard learned counsel for the petitioners as well as learned APP for the State.

2. The petitioners seek bail in anticipation of their arrest in a case registered for the offences punishable under Sections 302, 120(B), 201 and 34 of the IPC in connection with Kachhwa P.S. Case No.157 of 2023.

The learned counsel appearing on behalf of the petitioners submit that petitioners have been falsely implicated in the instant case by the informant with an allegation that his sister was married to the son of the petitioner no.1 in the year 2008 and after marriage the accused persons including the petitioners were torturing her for non-fulfillment of dowry

It is further alleged that on 03.11.2023 the sister of the informant informed him that she was going to her matrimonial home, but her husband has threatened to kill her if she comes to the home and thereafter the informant on 03.11.2023 called her sister on mobile but she did not respond, thus on 04.11.2023 he went to the matrimonial village of sister where he came know she was murdered.

4. The learned counsel submits that petitioners have been falsely implicated in the instant case. It is next submitted that the deceased along with her husband were living separately. It is also submitted that from perusal of the allegation as alleged in the FIR, it would manifest that informant alleges that the husband of the deceased was having an affair on account of which he used to torture his wife. It is also submitted that the husband of the deceased was separate in mess and property with the petitioners and the petitioners being father-in-law, elder brother-in-law, sister-in-law (Gotani) and mother-in-law came to be implicated in a mechanical manner with general and omnibus allegation.

5. The learned APP opposes the anticipatory bail application.

6. Considering the submissions made by the learned

No.20394 of 2024(3) dt.26-06-2024 3/3 counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks, are directed to be released on anticipatory bail on their furnishing bail-bonds in the sum of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Ist, Bikramganj, Rohtas in connection with Kachhwa P.S. Case No.157 of 2023, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

7. The application stands allowed.
