Petitioner in the present case claims that he is the Chairman of Khagaria Jila Janvitaran Pranali Vikreta Sangh, Khagaria which is a registered association. Several allegations have been made in the writ application against the respondent no. 7 but the bone of the contention of the petitioner is that the petitioner and other members of the association are not getting the supply of their allotted quantity of kerosene oil within time, therefore, they are unable to distribute the same among the

In the nature of the grievance raised before this Court, learned counsel for the State submits and rightly so that the petitioner should have approached the District Magistrate, Khagaria (Respondent No. 3) for redressal of his grievance. In the given facts and circumstances of the case, this Court is of the considered opinion that the petitioner if so advised may place his grievance before the District Magistrate, Khagaria with all supporting materials whatsoever he may willing to produce in support of the facts alleged in the writ application.

If such a grievance is raised before the District Magistrate, Khagaria by filing an appropriate application along with supporting materials within a period of 30 days from today, the same shall be considered by the District Magistrate, Khagaria by providing appropriate opportunity of hearing to all concerned including the private respondent no. 7 and thereupon a reasoned order shall be passed within a maximum period of 90 days from the date of submission of the application. The writ application stands disposed off accordingly.
