JUSTICE SUDHIR SINGH ORAL ORDER 13-07-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in connection with Mahua PS case No. 110 /2015 for the offence under section 498(A), 34 of the Indian Penal Code and Section 3⁄4 of Dowry Prohibition Act.

The prosecution story, in brief, is that the complainant, Chanchal Kumari, has leveled allegation of demand of dowry torture etc. in the complaint petition/ FIR against her husband and other in-laws.

It has been submitted on behalf of the petitioner that he is the husband of complainant and is ready to keep the complainant with full dignity but the same is not acceptable to the complainant.

Patna High Court Cr.Misc. No.24301 of 2015 (2) dt.13-07-2015 2/2 It has further been submitted that the petitioner has got no criminal antecedent. The petitioner states that he is ready to deposit a sum of Rs. 1000/- each month in the court below which may be released in favour of the complainant.

On behalf of the State it has been submitted that the petitioner is named in the first information report. Considering the aforesaid facts and circumstances, the petitioner is directed to deposit the amount of Rs. 1000/- each month in the court below and the same shall be released in favour of the complainant. With the said condition, the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, he shall released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Mahua P.S. case No. 110/ 2015, subject to condition as laid down under section 438(2) of the Cr. P.C.
