JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-05-2016 Heard learned counsels for the petitioner, informant and the State.

The petitioner is apprehending arrest in a case registered for the offences punishable under Section 302 of the Indian Penal Code.

The prosecution case is that the sister of the informant informed that this petitioner drown the 18 months son of the informant in a drain. The informant reached the spot and found his son drown in a drain then he took his son to hospital where the doctor declared him dead.

It is submitted by the learned counsel for the petitioner that only on suspicion the accusation has been levelled.

Patna High Court Cr.Misc. No.20388 of 2016 (2) dt.11-05-2016 2/2 Learned counsel for the informant submits that sister of the informant is eye witness of the occurrence. Considering the nature of accusation, let the learned court below consider the prayer for regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Mahakar P.S. case No. 9 of 2016 pending in the court of learned C.J.M., Gaya.

This application is disposed of with the aforesaid observation/direction.
