The petitioner seeks bail in Garkha P.S. Case No. 877 of 2021, registered for the offence punishable punishable under Section 30(a) of the Bihar Prohibition and Excise Act. 100 litres of illicit liquor has been recovered from a motorcycle which was kept hidden behind the house of coaccused Police Rai. Petitioner is alleged to be one of the persons who fled away from the place of recovery after seeing the police party.

It is submitted that no recovery has been made from conscious possession of this petitioner. Petitioner has got no concern with the seized liquor. Petitioner is in custody since 15.02.2022 having no criminal antecedent, as stated in para 3 of

Patna High Court CR. MISC. No.16617 of 2022(2) dt.20-05-2022 2/2 the petition. Investigation is complete.

Considering the period of custody coupled with the fact that petitioner bears clean antecedent, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Ist Exclusive Special Judge, Excise, Saran at Chapra in connection with Garkha P.S. Case No. 877 of 2021.
