This is an application for bail in connection with Nokha P.S. Case No. 210 of 2016, registered for the offences punishable under Sections 8(C), (B), 22, 27(A) and 29 of N.D.P.S. Act. Allegation against the petitioner is of recovery of 29 kg. of ganja from his house.

Submission of learned counsel for the petitioner is that the main accused from whose possession 16 kg. of ganja was recovered, has been granted bail. Further submission is that petitioner has nothing to do with the seized articles and he is in custody for more than one year having no criminal antecedent. Heard learned APP also.

Having heard both sides and in view of allegation, I am

Patna High Court Cr.Misc. No.45419 of 2017 (4) dt.07-11-2017 2/2 not inclined to grant bail to the petitioner. However, since the petitioner is in custody for more than one year, learned Special Judge, Rohtas, Sasaram, is directed to expedite the trial and try to conclude it within a period of seven months, if possible, by conducting the trial on day to day basis. At the same time, Superintendent of Police, Rohtas is directed to ensure presence of the witnesses in court so that trial be concluded within the said period. Needless to say that petitioner and other parties have to co-operate in disposal of trial. With the above observation, this application is dismissed. (Vinod Kumar Sinha, J) spal/- U
