JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-02-2015 Heard learned counsels for the petitioner and the State. The petitioners being the member of Ward Samiti and Panchayat Secretary are apprehending arrest in a case registered for the offences punishable under Sections 471, 409, 420 and 120B of the Indian Penal Code.
It is alleged that flood relieves were not given to the beneficiaries and the same has been misappropriated. It is submitted by learned counsel for the petitioners that
Patna High Court Cr.Misc. No.31573 of 2014 (2) dt.03-02-2015 2/2 after conclusion of the investigation, the petitioners were not sent up for trial, but differing with the final form, the cognizance was taken on 12.05.2014.
Considering the fact that during investigation, the accusation was found false, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Supaul in connection with Bhimpur P.S. Case No. 04 of 2009, subject to the conditions as laid down under Section 438(2) Cr.P.C.
