The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 313, 354, 379, 504/34 of the Indian Penal Code and section 3⁄4 of the Witch Practices Act. Learned counsel for the petitioners seeks permission to withdraw the petition with regard to petitioner No. 1 namely, Sunil Sahani.
Patna High Court CR. MISC. No.16587 of 2022(2) dt.12-09-2022 2/3 Permission is accorded.
Accordingly, the petition with regard to petitioner No. 1 is permitted to be dismissed as withdrawn.
It is a case of assaulting due to which the informant sustained injuries and her pregnancy got terminated.
It is submitted by learned counsel for the petitioners that petitioners have falsely been implicated in this case. The allegation against the petitioners, except petitioner No. 1 is general and omnibus. The informant and her husband sustained simple injuries caused by hard and blunts substance. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent.
