The petitioner seeks bail in connection with Paraiya P.S. Case No. 37 of 2018 registered for the offences punishable under Sections 304(B) and 34 of the I.P.C.
The allegation in the present case is regarding the accused persons having set the victim girl on fire on account of non-fulfillment of demand for dowry resulting in her death. The learned counsel for the petitioner has submitted that the allegation of setting the victim girl on fire is only against her brother-in-law namely Kundan Kumar. As far as the petitioner herein is concerned, there is no specific allegation of the petitioner having set the victim girl on fire. It is further submitted that in fact the petitioner and other family members have taken the victim girl
Patna High Court Cr.Misc. No.31668 of 2018 (4) dt.19-07-2018 2/2 to the hospital for treatment and thereafter when the victim girl had died and then a falsely and concocted story has been developed. Having regard to the facts and circumstances of the case, more particularly the fact that the main culprit in the present case is Kundan Kumar, I deem it fit and appropriate to grant regular bail to the petitioner Ambika Prasad on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Gaya in connection with Paraiya P.S. Case No. 37 of 2018.
