Petitioner is seeking regular bail in connection with Malsalami P.S. Case No.46 of 2018 punishable for the offence under section 302/34 of the Indian Penal Code. It is submitted that this petitioner is younger brother of the husband of the deceased lady who is separate in mess and business. Learned counsel submits that, so far as this petitioner is concerned, there is no specific allegation against him. The coaccused who are the mother-in-law, sister-in-law and brother-inlaw respectively in Criminal Miscellaneous No.23743 of 2018 have been granted privilege of anticipatory bail considering that the thrust of the accusation is against the husband.

Considering the facts and circumstance and the submissions made on behalf of the petitioner stating that this petitioner is the younger brother of the husband of the deceased, I am inclined to grant regular bail to the petitioner let the petitioner named above be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IV, Patna city in connection with Malsalami P.S. Case No.46 of 2018, subject to the conditions under Section 437(3) Cr.P.C.
