The petitioner seeks regular bail in connection with Sikarahata P.S. Case No. 68 of 2018 registered for the offence punishable under Sections 25(10b)a, 26 and 35 of the Arms Act. The allegation is regarding live cartridges having been recovered from the co-accused persons while they were caught by the Police when they were brandishing arms and the said apprehended co-accused had disclosed that the arms had been taken away by the petitioner while he had managed to flee away from the spot.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and in fact no recovery has been made from the petitioner. It is

The petitioner is stated to be languishing in custody since 17.11.2018. Lastly, it is submitted that the co-accused persons have already been granted bail by a coordinate Bench of this Court vide order dated 08.01.2019 passed in Criminal Misc. No. 78047 of 2018.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Bhojpur at Ara in connection with Sikarahata P.S. Case No. 68 of 2018.
