Petitioner prays for grant of bail in Kharagpur P.S. Case No. 143 of 2015 registered under Sections 341, 324, 325, 307, 302/34 of the Indian Penal Code.

Petitioner is not named in the First Information Report. There is allegation against three accused named in the F.I.R. of having assaulted the brother of the informant as well as the informant. The brother died. It is stated that nearly 09 days thereafter in his further statement, the informant implicated four accused including the petitioner. Referring to Annexure-2, it is stated that one of them has been granted privilege of bail. Petitioner has no criminal antecedent.

Taking note of the aforesaid submission, let the petitioner

Patna High Court Cr.Misc. No.48094 of 2017(2) dt.16-10-2017 2/2 abovenamed be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned District and Sessions Judge, Munger in Sessions Case No. 236 of 2017 (arising out of Kharagpur P.S. Case No. 143 of 2015) subject to the condition that one of the bailers shall be the own/close family members of the petitioner.
