Petitioner is in custody in connection with Malsalami P.S. Case No. 109 of 2018 corresponding Special Case No. 2647 of 2018 for offence under Sections 272, 273 of the Indian Penal Code and 30(a), 38 of the Bihar Prohibition and Excise Act, 2016.

Learned counsel submits that petitioner has no criminal antecedent. He has been implicated in this case only on suspicion. He submits that nothing was recovered from the conscious possession of the petitioner. It is alleged that the seizure list was prepared in complete violation of the provision of Criminal Procedure Code. He has remained in custody since 23.04.2018.
