2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 126(2), 115(2), 118(1), 109, 303(2), 352, 351(2), 351(3), 3(5) of the BNS, 2023.

3. The case of the prosecution is that the petitioner along with others started assaulting the informant. It is specifically stated in the FIR that Vikas Kumar Singh and Chhotu Kumar Singh assaulted with iron rod on the head of the informant, due to which he received head injury.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has

He also submits that the parties are agnates and the occurrence is taken place on the spur of the moment. There is only allegation of one blow. From perusal of the injury report, it transpires that the nature of injury is simple. It is further submitted that the petitioner is languishing in judicial custody since 14.01.2025.

5. Learned APP appearing for the state and learned counsel for the informant have opposed the prayer of regular bail and submits that the petitioner is having criminal antecedent of two cases.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Mohiuddin Nagar P.S. Case No. 276 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Samastipur.
