JUSTICE ASHUTOSH KUMAR ORAL ORDER 11-06-2020 Heard Mr. Manoj Kumar Manoj, learned counsel for the petitioner and learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Muzaffarpur Sadar P.S. Case No. 45 of 2020 dated 23.01.2020 instituted for the offences under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. It appears from the prosecution report that a Scorpio vehicle bearing taxi number was intercepted from where 28.020 litres of liquor was recovered. One Bablu Kumar, who was driving the vehicle was arrested. The

It has been urged on behalf of the petitioner that though he is the owner of the vehicle but he has let out his vehicle for being run commercially on roads. The petitioner had no idea that his vehicle would be used for transporting the liquor. The petitioner has clean antecedent. Considering these aspects of the matter, the petitioner, above named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Muzaffarpur, in connection with Muzaffarpur Sadar P.S.
