The petitioner has preferred this application for grant of regular bail in a case registered under sections 420, 401, 382, 379 and 34 of the Indian Penal Code.

As per the prosecution case, the accused persons stole a sum of Rs.49,500/ in cash from the informant inside the bank premises. In their attempt to escape one of them namely Satyendra Sharma was caught and he disclosed the name of his three accomplices who had managed to escape which included the petitioner herein.

It is submitted by learned Senior Counsel for the petitioner that the petitioner was neither arrested at the spot nor any incriminating article has been recovered from his

Patna High Court CR. MISC. No.26699 of 2021(2) dt.08-12-2021 2/2 possession. The only material being relied on against him is the statement of the coaccused made before the police. The petitioner is in custody since 27.11.2020 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner being in custody for over 1 year, the Court directs the petitioner to be enlarged on bail in connection with Mohaniya P.S. Case no.345 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Kaimur at Bhabua.
