The petitioner seeks bail in Basantpur P.S. Case No.56/2017 registered under Section 302/34 of the Indian Penal Code.

As per the prosecution case, petitioner and other accused persons are said to have assaulted the husband of the informant by means of knife inflicting fatal injury. It is submitted by learned counsel for the petitioner that the only allegation against the petitioner is that he along with other accused persons caught hold the deceased. In fact, he does not happen to be the assailant of the deceased rather the assailant is Deep Lal Rai. He has been falsely implicated in this case. He

Patna High Court Cr.Misc. No.46100 of 2017 (02) dt.20-09-2017 2/ 2 has been languishing in custody since 27.02.2017. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in connection with Basantpur P.S. Case No.56/2017.
