Taking note of this fact that the victim specifically stated in her statement recorded u/S 164 of the Cr. P.C. that this petitioner and co-accused, Om Prakash forcibly took away the victim, I am not inclined to extend the privilege of anticipatory bail to the petitioner and accordingly, his prayer for bail in connection with Karja P.S. Case No. 45 of 2013 pending in the court of Sub Divisional Judicial Magistrate (West), Muzaffarpur stands rejected. However, if, the petitioner surrenders in the court below and seeks regular bail, this order shall not cause any prejudice to the learned court below at the time of consideration of regular bail application of the petitioner.
