The petitioner apprehends arrest in connection with Aurangabad (T) Police Station Case No. 119 of 2017 registered punishable for the offences under sections 307, 379, 341, 323, 324, 504 and 506/34 of the Indian Penal Code. It has been submitted that altogether 4 FIR named and 10 unknown assaulted the informant and his friends. The allegation of causing knife blow is against Diwakar Kumar, who has already been allowed bail by one of the coordinate Bench of this Court in Criminal Misc. No. 35751 of 2017. The allegation against this petitioner is that he assaulted Vikash Kumar by means of Lathi. The injury report on record shows that Vikash Kumar
Patna High Court Cr.Misc. No.39719 of 2017 (3) dt.17-10-2017 2/2 sustained lacerated wound and abrasion, which was found simple in nature, by hard and blunt substance.
The learned Additional Public Prosecutor on the other hand, opposed the submission.
Considering the nature of allegation, injury, facts and circumstances, as stated above, this application for anticipatory bail is allowed.
Let the petitioner, above named, in the event of arrest or surrender before the Court below within a period of six weeks from the date of receipt or production of a copy of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Aurangabad (T) Police Station Case No. 119 of 2017, subject to the condition as laid down under Section 438 (2) of the Criminal Procedure Code.
