The petitioners apprehend their arrest in connection with Sasaram (Muffasil) P.S. Case No. 628 of 2017 for the offence punishable under Sections 341, 323, 324, 325, 307 and 34 of the Indian Penal Code.
Learned counsel appearing for the petitioners submits that the petitioners, who are of clean antecedent, are innocent and have not committed any offence. In fact, the petitioners reside at Chenari which is far away from the place of occurrence and they have no concern with the informant. These petitioners have falsely been implicated in
Patna High Court CR. MISC. No.15628 of 2019(3) dt.22-05-2019 2/2 this case. Moreover, there is no eye witness to the occurrence. Hence, the petitioners may be granted the privilege of anticipatory bail.
Learned counsel for the State has opposed the prayer for bail and submitted that the witnesses have supported the prosecution version which is evident from paragraph Nos. 1, 2 and 7 of the case diary. Moreover, the injury report also support the prosecution version. Considering the facts and circumstances of the case, this Court is not inclined to grant the privilege of anticipatory bail to the petitioners. Accordingly the prayer for grant of anticipatory bail of these petitioners is rejected. (Arvind Srivastava, J) brajesh/- U T
