The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323 and 498(A)/34 of the Indian Penal Code and Sections 3/4 of the DP Act.
It is a case of cruelty to the informant due to nonfulfilment of dowry demand by the petitioners and other accused persons.
It is submitted by learned counsel for the petitioners
Patna High Court CR. MISC. No.17881 of 2022(2) dt.19-09-2022 2/2 that the petitioners have falsely been implicated in this case. He further submits that the petitioner no.1 is Nanad, petitioner no.2 is mother-in-law and petitioner no.3 is Mausi of the informant and they have no concern with the mess and business of the informant and her husband, namely, Akash Kumar @ Vikash Kumar Sharaf. Petitioners have clean antecedent. Learned APP appearing for the State opposed the anticipatory bail.
Considering the aforesaid submissions, let the petitionerd, above named, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM, Raxaul, Motihari in connection with Trial No.1425 of 2021 arising out of Raxaul P.S. Case No. 238 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Sunil Kumar Panwar, J) Brajesh Kumar/- U T
